1. Introduction

Engaging with our Service through booking a charter or website use constitutes your agreement to these Terms. Should you disagree with any section of these terms, you are advised against using the Service.
2. Service Overview
PublicCommonsMatrix specializes in offering high-end yacht charter services, including:
- Exclusive yacht hire for a day
- Evening yacht tours
- Business offsite events
- Bespoke celebrations
- Extended yacht charters
All services are contingent on availability and favorable weather conditions. Our services can be amended or withdrawn at our discretion without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, you are required to:
- Be no younger than 18 years
- Provide valid and complete details
- Submit the necessary advance payment indicated in your reservation confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A reservation is only deemed confirmed once the requested payment is processed and confirmation is formally communicated by us. We maintain the discretion to decline service to any individual.
3.3 Availability
The availability of our yacht charters is subject to vessel allocation and optimal weather conditions. We endeavor to fulfill your preferred scheduling to the best of our ability.
4. Payment Terms
4.1 Pricing
All pricing details are provided in € and are inclusive of relevant taxes unless stated otherwise. Pricing is subject to adjustment and may change without prior notification.
4.2 Payment Schedule
- Deposit: Required to be 50% of the total charter fee, payable during booking
- Balance: Payable 48 hours in advance of charter departure
- Supplementary fees (if applicable): Charged following the charter completion
4.3 Payment Methods
Accepted methods of payment include most major credit cards, bank wire transfers, and certified cheques. We handle payment processing through secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Exceeding 72 hours prior to depart: Full reimbursement minus processing charges
- Within 24-72 hours before depart: Reimbursement of 50%
- Fewer than 24 hours until depart: Non-refundable
5.2 Weather Cancellations
If our captain determines the weather to be unsafe, we will propose to either:
- Reschedule the charter to another convenient date without additional cost
- Process a complete refund when rescheduling isn't feasible
5.3 Mechanical Issues
If mechanical difficulties occur with the designated vessel, we will aim to provide an appropriate alternative. Should a suitable replacement be unavailable, a full reimbursement will be issued.
6. Safety and Conduct
6.1 Safety Requirements
It is imperative that passengers:
- Heed all instructions from the crew
- Use the safety gear as instructed when necessary
- Disclose any health conditions that might affect their safety
- Stay within the designated areas of the vessel
6.2 Prohibited Items
Certain items are strictly forbidden on board the vessel:
- Containers made of glass
- Illegal drugs
- Firearms or any form of weapon
- Pets, unless previously authorized
6.3 Conduct
Behaving with decorum and respectfulness is expected from all passengers. If a passenger's conduct endangers safety or detracts from the experience for other guests, we retain the right to end the charter prematurely and no refund will be given.
7. Liability and Insurance
7.1 Our Liability
We restrict our liability to the cost paid for the charter. We hold no responsibility for:
- Injuries sustained as a result of passenger negligence
- Damage or loss of personal belongings
- Indirect, resultant, or special damages
- Delays induced by weather or other unavoidable circumstances
7.2 Insurance Coverage
Our vessels and operations are insured comprehensively. However, passengers should have their own travel and personal insurance.
7.3 Assumption of Risk
By choosing to take part in our charter offering, you recognize inherent risks associated with maritime activities and accept personal accountability for your safety and health.
8. Modifications and Itinerary Changes
We reserve the authority to alter itineraries, pathways, or schedules due to weather, safety, or operational requirements. All efforts will be made to offer equivalent alternative activities.
9. Force Majeure
We are not responsible for disruptions, cancellations, or changes that result from factors out of our control, including, but not limited to:
- Extreme weather events
- Natural disasters
- Legislation or government actions
- Port shutdowns
- Unforeseen mechanical breakdowns
10. Privacy and Data Protection
We treat your personal data according to our Privacy Policy. By engaging with our services, you consent to the gathering and utilization of your data as outlined in our Privacy Policy.
11. Intellectual Property
All material on our website, such as text, images, logos, and graphics, is subject to copyright and trademark protections. You are prohibited from copying, distributing, or deriving works from it without our express written consent.
